On May 3, 2021, around 2:30 p.m. officers from the Hawkesbury Detachment of the Ontario Provincial Police (OPP) spoke with a driver at the inter-provincial check point at East Hawkesbury Township. After a brief investigation by a Drug Recognition Expert (DRE) officer, the driver was arrested for Impaired Operation by a drug. Further investigation of the vehicle revealed a sawed-off shot gun and ammunition. The driver was charged under the Criminal Code (CC) with;

  • Operation while impaired – alcohol and drugs CC s.320.14(1)(a)
  • Transport firearm, in a careless manner – CC s.86(1)
  • Breach of firearms regulation- transport firearm – CC s.86(2)
  • Unauthorized possession of firearm – CC s.91(1)
  • Knowledge of unauthorized possession of weapon – CC s.92(2)
  • Occupant of motor vehicle knowing there was a firearm – CC s.94
  • Possession of firearm or ammunition contrary to Prohibition Order – CC s.117.01(1)
  • Failure to comply with release order – CC s.145(5)(a)
  • Possession of a firearm knowing serial number had been tampered with – CC s.108(1)(b)
  • Driving under licence of other jurisdiction while suspended in Ontario – Highway Traffic Act (HTA) s. 36
  • Drive vehicle with cannabis readily available – Cannabis Control Act (CCA) s.2017 12(1)
  • Driving motor vehicle with liquor readily available – Liquor Licence Act (LLA) s.32(1)
